What is the CCPA?

The California Consumer Privacy Act (CCPA) is a California data privacy law that is enforceable starting July 1, 2020. The law sets new standards for data collection of users, and cites new consequences for companies that fail to protect the data of their users. It also outlines the new rights that users from California can exercise over their data.

Like the GDPR the CCPA aims to:

  1. Grant users rights over their data through access, transfer, editing, and deletion requests
  2. Give consumers the ability to opt out of certain data-processing practices
  3. Establish greater consequences for businesses that fail to adequately protect data
  4. Shift accountability for data protection onto businesses that collect and handle user information


Who does the CCPA affect?

Businesses that collect Californian consumer data are subject to comply with the CCPA.

Businesses are for-profit entities that collect consumer data.

They must also meet ONE of the following thresholds:

  1. Annual gross revenue over $25 million
  2. Annually buys, receives, sells, or shares the personal information of >50,000 consumers, households, or devices.
  3. Derives 50% or more of its annual revenue from SELLING consumer personal information

2. New CCPA Consent Banner

You can now add a Decline Button on your consent banner. This allows for an opt-in and opt-out rule, necessary within the CCPA guidelines. This will be automatically updated for you, there is no need to re-scan your website!

3. Do Not Sell Link

Termly users can now add a CCPA “Do Not Sell” Link on their website. This link opens up to the cookie preference center.



4. CCPA-Compliant DSAR Forms

While our DSAR's have always been compliant with GDPR regulations, we have updated them so that they are also usable for businesses targeting Californian consumers. Read more about our DSAR forms.
